(1) The Guarantor guarantees the proper operation of the Product within 24 months from the date of issue of the Product to the buyer who is a consumer on the basis of the document confirming the purchase.
(2) The Guarantor's liability under the warranty covers only physical defects (material or manufacturing) under normal use and maintenance or arising from causes inherent in the Product sold.
(3) This warranty does not cover any problems related to condition or damage not due to defects in material or manufacture, such as:
(4) The complaint should be filed at the retail outlet where the product was purchased, together with a document confirming the purchase (receipt or invoice), on the basis of which the warranty period is determined.
(5) In order to speed up consideration of the complaint by the Guarantor, please provide in the description of the complaint:
(6) Complaints submitted without the information contained in section 6. will be considered, although in this case the deadline for fulfillment of warranty benefits by the Guarantor is extended to 30 days. In the absence of a description, the equipment will be inspected in a general way, but this does not give certainty of detecting a defect. If the undescribed defect is not detected, the equipment will be returned in the condition in which it was sent to the service, and the decision to consider the complaint will be denied.
(7) The person entitled to the warranty should deliver the advertised product to the point of purchase in a closed, properly protected package reducing the risk of damage to the product. The guarantor will reimburse the entitled person for the documented costs of delivering the item. The warrantee is not entitled to reimbursement from the Guarantor for the cost of delivering the item for warranty repair, exceeding the economically reasonable transportation costs.
(8) The refusal of the warrantee to deliver the product or the advertised part for repair shall result in the release of the Guarantor from the performance of warranty obligations under that particular warranty claim.
(9) The Guarantor is obliged to perform its obligations under the guarantee immediately, no later than within 14 days. This period shall be counted from the date of delivery of the Product to the Guarantor. After exercising its rights under the guarantee, the Guarantor will deliver the Product to the warranty holder at the sole expense of the warranty holder, which will be reimbursed to the Guarantor in the amount and within the period indicated in the accounting document attached to the shipment.
(10) Under this warranty, the Guarantor shall be obligated to remove defects in the Product or, at its option, to deliver a defect-free Product if such defects become apparent within the period specified in the warranty. If it is not possible to remove the defects of the Product or to deliver the Product free of defects, the warranty holder is entitled to a refund of the amount paid for the Product.
(11) If the complaint is not accepted, the consumer shall receive a written justification for the refusal of the complaint, and the product shall be sent back to the place of purchase at the sole expense of the claimant, which will be refunded to the Guarantor in the amount and within the period indicated in the accounting document attached to the shipment.
(12) Repair by unauthorized persons or the use of non-original parts for repair, prior to the delivery of the product to the Guarantor or after the return of the product by the Guarantor, shall result in the definitive loss of warranty rights.
13 The Guarantor reserves the right to make changes and upgrades to the product, not affecting its overall appearance. Any defective products or parts that are replaced will become the property of the Guarantor.
(14) The Guarantor shall not be liable in case of violation of the deadlines for repair and collection or delivery of the device to be repaired, if the delay in this regard is caused by Force Majeure. In such a case, these deadlines shall be extended by the period of the Force Majeure, but the Guarantor shall endeavor to keep the deadline not longer than 90 days, although in the case of Force Majeure it is not obliged to keep the deadline. Force Majeure shall mean any external event of an extraordinary nature, which the Guarantor performing or about to perform warranty repair of the device is unable to prevent and over which this event has no control, which includes, but is not limited to, riots, strikes, industrial disputes, armed conflicts and natural disasters.
(15) The above warranty provisions fully exhaust the Guarantor's liability for defects under the warranty.
(16) The Guarantor shall not be liable for financial losses or other civil law consequences caused by a defect in the advertised device.
(17) The territorial scope of warranty protection covers the territory of the Republic of Poland.
(18) The warranty does not exclude, limit or suspend the rights of the buyer under the warranty for defects of the sold thing.
(19) In all matters not covered by these Warranty Terms and Conditions the provisions of the Civil Code shall apply.
